Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and [Your legal name] (“we”, “us”) governing your use of the MakeApp mobile application (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, in accordance with these Terms and the Apple App Store Terms of Service.

2. Eligibility

You must be at least 13 years old (or 16 where required by local law) to use the App.

3. Your photos and content

• You keep all rights to the photos you provide. You grant us only the limited rights needed to process your photo to generate your result, as described in our Privacy Policy.
• You must only upload photos you have the right to use. Do not upload photos of other people without their consent, or any unlawful, infringing, or offensive content.
• You are responsible for how you use your results.

4. AI results — not professional advice

MakeApp uses artificial intelligence to produce makeup suggestions and a visual simulation preview. Results are for inspiration only, are generated automatically, and may be inaccurate. They are not professional, dermatological, medical, or cosmetic advice, and actual results vary with skin, lighting, products, and technique. Use your own judgment, and patch-test products as appropriate.

5. Subscriptions and purchases

• The App offers auto-renewing subscriptions (for example, weekly and annual plans) and one-time credit packs, purchased through your Apple account.
• Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel a subscription in your Apple account settings after purchase.
• One-time credit packs are consumable and are used as you generate results; consumables generally cannot be restored. Prices are shown in the App before purchase.
• Payments, refunds, and billing are handled by Apple under the Apple Media Services Terms and Conditions; refund requests are made to Apple.

6. Acceptable use

You agree not to misuse the App, including by reverse-engineering it, interfering with its operation, attempting to access it through unauthorized means, or using it to violate any law or the rights of others.

7. Intellectual property

The App, its design, and its content (excluding your photos) are owned by us or our licensors and are protected by applicable laws. These Terms do not grant you any rights in our trademarks or branding.

8. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that results will meet your expectations.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the 12 months before the claim.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or your violation of these Terms.

11. Apple App Store

The following apply because you obtained the App through the Apple App Store:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

12. Governing law

These Terms are governed by the laws of [your country/state], without regard to its conflict-of-laws rules, except where local consumer-protection laws give you additional rights.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the revised Terms.
